Definitions
In these terms and conditions, the following definitions apply:
Agreement: The contract between the photographer and the client (the customer).
Assignment: The service or product provided by the photographer.
Photographer: Eva Huizing Photography, Chamber of Commerce 71805915.
Client: The individual or legal entity with whom the photographer has entered into an agreement and who also accepts these terms and conditions.
Cancellation: Termination or dissolution of the agreement.
In Writing: Electronic communication such as email, WhatsApp, etc., provided the identity of the sender and the authenticity of the communication are sufficiently established. The burden of proof for the receipt of electronic communication always lies with the client.
Use: Reproduction and/or public display as defined in the Copyright Act of 1912.
Quotes
All price quotations, offers, and proposals from the photographer (in any form) are non-binding, unless explicitly stated otherwise.
Selection & Photography Style
The image selection of a photoshoot is done by Eva Huizing Photography. Access to unedited files is not possible. Post-processing is determined by the photographer, and the client has no influence over this. The photos are delivered in the style of Eva Huizing Photography and will be edited according to the photographer's discretion and taste. Editing includes general optimization of light, contrast, color, and cropping. Post-editing by the client is prohibited under the Copyright Act of 1912.
Eva Huizing Photography does not provide raw (RAW) files.
Delivery
The edited photos will be delivered in JPG format within the agreed timeframe. Photos and previews will only be delivered after full payment has been received. The number of photos provided depends on the duration of the photography session and the events during the shoot. 7 days after delivery of the JPG's the RAW photo's will be deleted by the photographer.
Photo Album
After receiving the edited photos, the client can choose a photo album. The photographer will provide a price quote and a preview of the layout. The client can make minor changes before the album is finalized. No changes can be made after the order has been placed.
No Refunds
Eva Huizing Photography does not provide refunds if a photoshoot does not go as expected. If the shoot does not go as planned, the photographer will decide whether to continue the shoot. Force majeure (such as illness) may be a reason to reschedule the shoot.
Use of Photos - Copyright
The copyright and ownership rights of the photos remain with Eva Huizing Photography. The photographer may use the photos for the website, promotions, advertisements, and social media. If the client does not wish this, they must notify the photographer in writing prior to the photoshoot. The client may use the photos on social media, provided Eva Huizing Photography is credited. Editing of the photos by the client is prohibited.
Storage of Files
The client is responsible for storing and backing up the photos. The photographer is not liable for loss of files and will not resend photos.
Payment
Upon signing the quote, Eva Huizing Photography expects a deposit of 30%. The remaining 70% must be paid before the photo report is delivered.
For cancellations between May and September, the 30% deposit will not be refunded due to high demand during this period.
For cancellations between October and April, the deposit will be refunded if the cancellation occurs more than 30 days before the scheduled assignment.
Additional costs may apply depending on the timing of the cancellation.
Cancellation by the Photographer
In case of cancellation or force majeure, the client will be notified as soon as possible. The client may choose a substitute photographer or a full refund of the payment.
Force Majeure
In the event of force majeure (such as natural disasters, epidemics, war, or theft of equipment), Eva Huizing Photography is not liable. If the client cancels due to force majeure, the 30% deposit will not be refunded.
Liability
Eva Huizing Photography is not liable for damage occurring during the shoot, including but not limited to:
- Damage or stains on clothing
- Use of smoke bombs, sparklers, or other effects
- Color discrepancies on non-calibrated screens or prints not provided by the photographer
- Instructions from the photographer
- Bites from ticks or other insects
Additional Information
Travel costs: €0.39 per km
The photographer is not responsible if not all desired people are in the photos. It is the responsibility of the client to inform the photographer in advance.
Privacy & Personal Data
Eva Huizing Photography will never share personal data without the client’s consent.
Complaints
Complaints about the execution of the assignment or invoices must be submitted in writing within 7 days after delivery. A suitable solution will always be sought, but no refunds will be given. Complaints submitted after this period will not be processed.
By agreeing to these terms, the client confirms they have read and accepted them. By signing the quote, the client agrees to the terms as stated in these General Terms and Conditions of Eva Huizing Photography.
Definities In deze algemene voorwaarden wordt verstaan onder:
- Overeenkomst: De overeenkomst van opdracht tussen fotograaf en opdrachtgever (de klant).
- Opdracht: De dienst of het product dat door de fotograaf geleverd wordt.
- Fotograaf: Eva Huizing Photography, KVK 71805915.
- Klant: De (rechts)persoon of personen waarmee fotograaf de overeenkomst gesloten heeft en die tevens deze algemene voorwaarden aanvaardt.
- Annuleren: Beëindiging of ontbinding van de overeenkomst.
- Schriftelijk: Elektronische communicatie zoals e-mail, WhatsApp, etc., mits de identiteit van de afzender en de authenticiteit van de communicatie voldoende vaststaat. De bewijslast betreffende ontvangst van elektronische communicatie ligt te allen tijde bij de klant.
- Gebruik: Verveelvoudigen en/of openbaar maken in de zin van de Auteurswet 1912.
Offertes Alle prijsopgaven, offertes en aanbiedingen van fotograaf (in welke vorm dan ook) zijn vrijblijvend, tenzij het tegendeel daaruit uitdrukkelijk voortvloeit.
Selectie & Fotografie Stijl De beeldselectie van een fotoshoot wordt door Eva Huizing Photography gedaan. Inzage in de onbewerkte bestanden is niet mogelijk. De nabewerking wordt door de fotograaf bepaald en de klant heeft hierin geen inspraak. De foto's worden geleverd in de stijl van Eva Huizing Photography en worden naar inzicht en smaak van de fotograaf bewerkt. Bewerking omvat globale optimalisatie van licht, contrast, kleur en uitsnede. Nabewerking door de klant is verboden volgens de Auteurswet 1912.
Eva Huizing Photography levert geen onbewerkte (RAW) bestanden.
Levering De bewerkte foto's worden in JPG-formaat binnen een overeengekomen termijn digitaal geleverd. Foto's en previews worden pas geleverd nadat volledige betaling is ontvangen. Het aantal aangeleverde foto's is afhankelijk van de duur van de fotografie en de gebeurtenissen tijdens de shoot. 7 dagen na aflevering van de JPG bestanden worden de RAW bestanden verwijderd door de fotograaf.
Fotoalbum Na ontvangst van de nabewerkte foto's kan de klant kiezen voor een fotoalbum. De fotograaf maakt een prijsopgave en deelt een preview van de opmaak. De klant kan kleine wijzigingen doorvoeren voordat het album definitief wordt besteld. Na plaatsing van de bestelling kunnen geen wijzigingen meer worden aangebracht.
Geen Geld Terug Eva Huizing Photography geeft geen geld terug indien een fotoshoot niet naar verwachting verloopt. Indien de shoot niet naar wens verloopt, beslist de fotograaf of de shoot wordt voortgezet. Overmacht (zoals ziekte) kan een reden zijn om de shoot te verplaatsen.
Gebruik van de Foto’s - Auteursrecht Het auteursrecht en eigendomsrecht van de foto's blijft bij Eva Huizing Photography. De fotograaf mag de foto's gebruiken voor website, promoties, reclames en sociale media. Indien de klant dit niet wenst, dient dit voorafgaand aan de fotoshoot schriftelijk te worden aangegeven. De klant mag de foto's op sociale media gebruiken, mits Eva Huizing Photography wordt vermeld. Bewerken van de foto's door de klant is verboden.
Bewaren van Bestanden De klant is verantwoordelijk voor het opslaan en bewaren van de foto's. De fotograaf is niet aansprakelijk voor verlies van bestanden en levert geen foto's opnieuw aan.
Betaling Bij ondertekening van de offerte verwacht Eva Huizing Photography een aanbetaling van 30%. De resterende 70% dient voor de levering van de fotoreportage te worden voldaan.
- Bij annulering tussen mei en september wordt de aanbetaling van 30% niet terugbetaald vanwege de grote vraag in deze periode.
- Bij annulering tussen oktober en april wordt de aanbetaling terugbetaald als de annulering meer dan 30 dagen voor de geplande opdracht plaatsvindt.
- Afhankelijk van het moment van annuleren kunnen extra kosten in rekening worden gebracht.
Annulering door de Fotograaf Bij annulering of overmacht wordt de klant zo spoedig mogelijk op de hoogte gesteld. De klant kan kiezen voor een vervangende fotograaf of volledige restitutie van de betaling.
Overmacht Bij overmacht (zoals natuurrampen, epidemie, oorlog, of diefstal van apparatuur) is Eva Huizing Photography niet aansprakelijk. Indien de klant annuleert vanwege overmacht, wordt de 30% aanbetaling niet terugbetaald.
Aansprakelijkheid Eva Huizing Photography is niet aansprakelijk voor schade ontstaan tijdens de shoot, inclusief maar niet beperkt tot:
- Schade of vlekken aan kleding.
- Gebruik van rookbommen, sterretjes of andere effecten.
- Kleurafwijkingen op niet-gekalibreerde schermen of afdrukken die niet door de fotograaf zijn geleverd.
- Instructies van de fotograaf.
- Beten van teken of andere insecten.
Aanvullende Informatie
- Reiskosten €0,39 per km
- De fotograaf is niet verantwoordelijk als niet alle gewenste personen op de foto staan. Het is de verantwoordelijkheid van de klant om dit vooraf te melden.
Privacy & Persoonsgegevens Eva Huizing Photography deelt nooit persoonsgegevens zonder toestemming van de klant.
Klachten Klachten over de uitvoering van de opdracht of facturen dienen binnen 7 dagen na levering schriftelijk te worden ingediend. Er wordt altijd gezocht naar een passende oplossing, maar er wordt geen geld teruggegeven. Klachten na deze termijn worden niet meer in behandeling genomen.
Door akkoord te gaan met deze voorwaarden, verklaart de klant deze te hebben gelezen en te accepteren. Met ondertekening van de offerte gaat de klant akkoord met de voorwaarden zoals vermeld in deze Algemene Voorwaarden van Eva Huizing Photography.
